On Wednesday, September 11, the Federal High Court in Abuja granted bail to 10 #EndBadGovernance protesters accused of attempting to overthrow President Bola Tinubu between July 1 and August 4. The judge, Justice Emeka Nwite, set the bail at N10 million each with stringent conditions.


The defendants must provide a surety who is a property owner in Abuja, with the surety required to deposit the property documents with the court and swear an affidavit of means. This ensures that the defendants will fulfill their bail conditions and appear in court as required.


In addition to the initial bail conditions, Justice Nwite ordered the defendants and their sureties to surrender their international passports and provide three recent passport photographs to the court. This further ensures their compliance with the bail terms.


Despite the Inspector General of Police's objection, Justice Nwite granted bail to the defendants but imposed a crucial condition: they must abstain from participating in any public rallies during the trial. The defendants will remain in prison custody until they fully meet the bail conditions.


The trial, set to commence on September 27, revolves around charges of treason against the defendants, who allegedly waged war against Nigeria during a week-long nationwide protest. They are accused of violating Sections 96, 410, and 413 of the Penal Code, prompting the legal action against them.


The Inspector General of Police alleges that the protesters engaged in a series of unlawful activities, including:

  • Breaking into the Abacha Army Barracks
  • Inciting the military to overthrow President Tinubu's government
  • Attempting to force entry into the seat of power
  • Burning a police station and injuring police officers
  • Inciting the public against the government
  • Destroying various public properties, including:
  •  A police station
  •  A High Court complex
  •  Facilities belonging to the National Communications Commission (NCC)
