Appeal Court Rejects APC's Case While Upholding Governor Sim Fubara's Election Victory

The Court of Appeal sitting in Lagos state today November 28 dismissed the petition filed by the governorship candidate of the All Progressive Congress (APC)



The APC, Cole's sponsor, withdrew its petition against Fubara's victory, the tribunal said in dismissing the petition.


The petition that Patrick Tonye-Cole, the All Progressives Congress (APC) candidate for governor of Rivers State, filed against Governor Siminalayi Fubara of the Peoples Democratic Party (PDP) and the Independent National Electoral Commission (INEC) was dismissed on Tuesday by an Appeal Court in Lagos State.


Furthermore, the Accord Party's petition was denied by the appellate court.

Present in the courtroom on Tuesday, the APC candidate requested that the court order INEC to proclaim him the victor of the March governorship election in Rivers.


In October, Cole's petition contesting Fubara's election as the state's governor was denied by the Rivers State Governorship Election Petition Tribunal.

The APC, which supported Cole, withdrew its challenge to Fubara's victory, according to the tribunal, which rejected the case.


The APC candidate went to the appeal court because he was not happy with the Tribunal's decision. But on Tuesday, the court upheld the Tribunal's decision, which had earlier confirmed Fubara's election triumph in October.
