An appeals court in Port Harcourt has issued a warning against adhering to the decision of a Rivers State High Court in a criminal case brought by the Rivers State Government against Rotimi Amaechi, a former governor of the state, and five other individuals.

On May 17, 2023, a warrant for the arrest of former Rivers State Governor Amaechi, APC candidate for governor Patrick Tonye-Cole, former state commissioner for energy Augustine Wokocha, and three others was issued by the State High Court, presided over by Justice Chiwendu Nwogu.

On Friday, when the matter was brought back before the Appeal Court, Amaechi's attorney, Akin Olujimi, Senior Advocate of Nigeria, SAN, informed the court that Justice Nwogu of the state High Court had made a decision regarding the criminal suit that was in violation of the stay of proceedings still pending before the Appeal Court.

Olujimi further called the court's attention to a request to quash the actions of the Rivers State High Court that was pending before the appellate court but ignored by the state High Court.

After the parties engaged in argument and adopted their final written addresses, a three-person panel presided over by Justice Joseph Ikyegh reserved judgment on the applications.

Justice Ikyegh issued a warning that all actions must halt while the Appeal Court's decision is being considered.
