The House of Representatives has made a landmark decision, resolving to dismiss Danladi Umar as Chairman of the Code of Conduct Tribunal (CCT) during their plenary session on Tuesday, November 26. This decision was based on legal provisions, including Paragraph 17(3) of Part 1 in the Fifth Schedule of the 1999 Constitution (as amended) and Section 22(3) of the Code of Conduct Bureau and Tribunal Act, Cap C15 LFN 2004.
In a similar move, the Senate had earlier invoked Section 157 (1) of the Nigerian Constitution to remove Yakubu Danladi Umar as Chairman of the Code of Conduct Tribunal (CCT), citing gross misconduct and actions deemed unfit for the high office. This decision was made due to concerns about Umar's behavior, which was deemed inappropriate for someone in his capacity. The Senate described his actions as unacceptable and emphasized the need for the CCT Chairman to uphold the highest standards of integrity and morality.
In a historic move, the Senate reached a two-thirds majority to remove Danladi Umar as Chairman of the Code of Conduct Tribunal (CCT) on Wednesday, November 20. A total of 84 Senators supported the motion, with 74 endorsing it through signatures and 10 present during the session.
The process began with a closed-door session, where Senators deliberated on the matter. Upon resumption, Senate Whip Senator Mohammed Tahir Monguno moved for action under Section 157 (1) of the Constitution. This marked a significant step towards Umar's removal, following numerous allegations of misconduct and corruption.
The Senate's decision was influenced by various petitions and allegations against Umar, which raised concerns about his leadership at the CCT. The Senate Committee on Ethics, Code of Conduct, and Public Petitions invited Umar to investigative hearings, but he only attended once and evaded further invitations.
The motion to remove Danladi Umar as Chairman of the Code of Conduct Tribunal (CCT) was presented by Senate Leader, Senator Opeyemi Bamidele. The motion, titled “Invocation of the Provision of Section 157 (1) of the Constitution of the Federal Republic of Nigeria 1999, as Amended, for the Removal of the Chairman of the Code of Conduct Tribunal,” marked a significant step towards holding Umar accountable for his actions.
