Sanusi's Reinstatement as Emir of Kano Halted by Court

Court prevents Lamido Sanusi from being appointed Kano's emir again



Ex-parte orders from a Federal High Court in Kano prohibit State Governor Abba Kabir Yusuf from restoring Emir Muhammadu Sanusi II until a substantive lawsuit challenging the reinstatement is settled.


The edict also opposes the removal of the emirates of Bichi, Gaya, Karaye, and Rano.


The State House of Assembly approved a bill on Thursday, May 23, which led to the reinstatement.


All parties concerned, however, have been directed by the court to preserve the status quo pending the resolution of the lawsuit that Sarkin Dawaki Babba and Aminu Babba-Dan'Agundi filed on the same Thursday.


Permission to issue and serve a concurrent originating motion and other court processes on the sixth defendant, the Inspector General of Police (IGP), in the Federal Capital Territory (Abuja) and outside the Honourable Court's jurisdiction has been granted by Justice A.M. Liman of the Federal High Court to the Plaintiff/Applicant.


The Kano State Government, the Kano State House of Assembly, the Speaker of the State Assembly, the Inspector General of Police, the Commissioner of Police for Kano State, the Nigerian Security and Civil Defense Corps, and the Department of State Services are the defendants in this lawsuit.


Judge Liman directed that during the hearing of the Fundamental Rights application, scheduled for Monday, June 3, the parties address the court with the constitutional and jurisdictional issues that are evident on the application's face.



“That in order to maintain the peace and security of the state, an Interim Injunction of this Honourable Court is granted restraining the Respondents from enforcing, executing, implementing and operationalizing the Kano State Emirate Law Council (Repeal) Law.


“That parties are hereby ordered to maintain status quo ante the passage and assent of the bill pending the hearing of the Fundamental Rights application.”


The case was postponed by the judge until June 3, 2024.


Remember that on Thursday, May 23, Governor Abba Yusuf formally declared Sanusi's reappointment as Kano's emir.
