Peter Obi of the Labour Party ultimately drags Tinubu and the APC before the presidential election petition tribunal


The Labour Party LP and its presidential candidate in the February 25 election, Mr Peter Gregory Obi, have petitioned the Presidential Election Petition Tribunal in Abuja to challenge the Independent National Electoral Commission's declaration of Bola Ahmed Tinubu of the All Progressives Congress, APC, as the election winner.


Obi and LP are asking the court to rule that Tinubu and Kashim Shettima were not qualified to run in the Presidential election on February 25, 2023.


In the petition, which is based primarily on the alleged double nomination, the Petitioners want the tribunal to declare all votes cast for Tinubu in the election as wasted votes due to Tinubu and Shetima's non-qualification.


They want the petition to be decided on the basis of the remaining votes after discounting the votes credited to Tinubu, the first petitioner, Peter Obi scored a majority of the lawful votes cast at the election and had nothing less than 25% in each of at least two-thirds of the states of the federation and the Federal Capital Territory Abuja, and satisfied the constitutional requirements to be declared the winner of the 25th February 2023 Presidential Election.


They further claimed that Tinubuit was not eligible to be recognized and returned as the victor of the presidential election held on Saturday, February 25, 2023 because he did not receive one-quarter of the votes cast in the Federal Capital Territory of Abuja.


It will be remembered that the Independent National Electoral Commission INEC Chairman, Prof Mahmud Yakubu, proclaimed Tinubu president-elect on March 1 after he received 8,805,835 votes.


However, Obi and Atiku have appealed for the results to be annulled, claiming misconduct as a result of the election umpire's failure to electronically upload results from polling units to the INEC Results Viewing Portal quickly.


According to the Election Act, dissatisfied candidates have 21 days from the day the election results are announced to file their petitions.

According to reports, Labour Party filed its petition with the Presidential Election Petition Registry at 8 p.m. on Monday, one day before the deadline, through Obi's legal team.
