ENUGU STATE LABOUR PARTY CANDIDATE EDEOGA IS UPHELD BY THE SUPREME COURT
Chijioke Edeoga was recognized as the legitimate Labour Party candidate for governor of Enugu State by the Supreme Court on Monday.
Earlier, a Federal High Court in Abuja ordered a new election, but Edeoga went farther and appealed the decision.
After receiving a favorable ruling, Nnaji appealed to the Supreme Court.
The Supreme Court's decision on Monday favored Edeoga.
The Court of Appeal's Abuja Division's earlier decision naming Edeoga as the legitimate Labour Party Governorship Candidate was supported by the Supreme Court.
Nnaji (Odengene) was characterized by a full panel of the Supreme Court, presided over by Justice Kekekere Ekun, as an intrusive outsider who shouldn't have gone to court in the first place because he didn't take part in the Labour Party Governorship Primaries.
Because Mr. Nnaji did not participate in the party's primary election and is unable to convince the court that he was duly nominated by consensus in accordance with the Electoral Act of 2022 because he failed to show that there was a special convention affirming him as the consensus candidate, the Apex Court ruled that the appeal was dead on arrival.
The appellant's contention at the trial court that led to the appeal was illegal, and the appellant lacked the necessary locus standi, the court agreed with the lead attorneys for the Labour Party, Alex Ejesieme, SAN, and M.J. Numa, SAN.
