COURT DISMISSES PRESIDENTIAL CANDIDATE AND ORDERS A REPLACEMENT

Hamza Al-Mustapha

The Action Alliance (AA) candidate for president, Major Hamza Al-Mustapha, has been dismissed by a Federal High Court in Abuja (rtd).

The Independent National Electoral Commission (INEC), which is chaired by Justice Z.B. Abubakar, was directed by the court to refuse to accept all of the candidates put out by the wing of the party led by Kenneth Udeze.

The Judge went on to say that the faction loyal to the party head instead filed its candidates. Adekunle Rufai Omoaje ought to be acknowledged for the elections in 2023.

News reporters in Kaduna were informed of the court judgment on Saturday.

Justice Abubakar cited section 29(1) of the Electoral Act of 2022 in his decision that INEC publicize all of the candidates' names and addresses that Omoaje had submitted on behalf of the Action Alliance.

"By the provision of section 29(1) of the Electoral Act, 2022, the INEC should publish by displaying at the relevant office or offices of INEC and on its website."

It is understood that Omoaje filed a lawsuit challenging INEC's refusal to accept the candidates he presented on behalf of the party for the elections in 2023, which led to the court ruling.

Omoaje stated that Kenneth Udeze should quit posing as the AA National Chairman because he has been dismissed from the party as of February 14, 2020, during the party's National Convention in Osogbo.
