10-Year Jail Term for Lagos Pedophile, N1m Restitution to Victim

Man, 10 Years in Jail for Defiling 9-Year-Old in Lagos, Pays N1m

“The gravity of your offence cannot be overstated as it weighs heavily upon this court...”

Lagos court convicts Stanley Mbadiwe of child sexual assault, sentences him to 10 years imprisonment. Consecutive 7-year & 3-year terms for indecent treatment & assault.

A Lagos man, Stanley Mbadiwe, has been sentenced to 10 years in prison for sexually assaulting and indecently treating a nine-year-old girl. The verdict was delivered by Justice Rahmon Oshodi at an Ikeja Sexual Offences and Domestic Violence Court.

Initially, Mbadiwe pleaded not guilty to defilement charges in 2019. However, he later changed his plea to guilty after the Lagos State Government filed amended charges.

Justice Oshodi consequently convicted Mbadiwe, ensuring justice for the young victim.

During the trial, the victim and her mother testified against Mbadiwe, recounting the horrific event where he forcibly had carnal knowledge of the young girl. In a recent development, the prosecution revealed that a plea deal was signed on October 10, 2024, which likely influenced the sentencing. As part of the sentence, Mbadiwe must pay N1 million in compensation to the victim.

Pointers:

  • Sentence: Mbadiwe sentenced to 10 years in prison
  • Crime: Sexual assault of a nine-year-old girl in May 2018
  • Location: Isolo, Ikeja division, Lagos
  • Plea Deal: Signed on October 10, 2024
  • Compensation: N1 million to be paid to the victim

Stanley Mbadiwe was re-arraigned on two amended counts: indecent treatment of a child under Section 135 of the Criminal Law and sexual assault under Section 263. He pleaded guilty to both counts, which the court accepted.

When delivering the judgment, Justice Rahmon Oshodi considered the case facts, plea bargain agreement, and relevant laws. This careful consideration led to Mbadiwe's 10-year prison sentence and an order to pay N1 million in compensation to the victim.

Case Details

  • Crime: Indecent treatment and sexual assault of a minor
  • Location: Lagos, Nigeria
  • Sentence: 10 years imprisonment, N1 million compensation
  • Relevant Laws: Sections 135 and 263 of Lagos State's Criminal Law

“Stanley Mbadiwe, I have found you guilty of indecent treatment of a child and sexual assault contrary to Section 135 and 263 of the criminal law of Lagos State,” the judge said.

“The gravity of your offence cannot be overstated as it weighs heavily upon this court; you sexually assaulted a nine-year- old girl, a vulnerable member of our society, yet have pleaded guilty to a lesser charge.

“Your reprehensible actions have not only convicted the bodily integrity of an innocent child but have also, in all likelihood, inflicted a long-lasting emotional and psychological trauma that will haunt the victim for years to come.

“The plea bargain contained a compensation clause under section 272 of the administration of the criminal justice law of Lagos State as amended in 2021. I accept that the N1 million compensation paid to the victim's family demonstrated a measure of genuine remorse on your part.

“However, I must note that no financial compensation can genuinely undo the harm you have caused.”

The court delivered a dual sentence:
  • Count 1: 7 years imprisonment for indecent treatment of a child
  • Count 2: 3 years imprisonment for sexual assault.

“I now sentence you to 10 years imprisonment from your remand on May 8, 2018. Furthermore, you shall be registered as a sex offender a designation that will follow you long after your release,” the judge added.

Stanley Mbadiwe will spend a total of 10 years behind bars, as the court ruled that the seven-year sentence for indecent treatment of a child and the three-year sentence for sexual assault will run consecutively, in line with the plea bargain agreement between the parties. This means he'll serve the full 10 years without any overlap or reduction in his sentence.
