Federal High Court Orders Emir Sanusi's Removal from Palace
Emir Sanusi's eviction from Kano Palace is ordered by another court, sparking a battle for emirship.
The reinstated Emir, Muhammadu Sanusi II, has been ordered to leave Kofar Kudu Palace by a Federal High Court located in Kano, just twenty-four hours after a Kano State High Court ordered the deposed Emir of Kano Bayero and four others to cease presenting themselves as emirs.
The ongoing emirship dispute was further complicated by the Court's decision to intervene and order the Police to guarantee that Aminu Bayero, the 15th Fulani Emir of Kano, receives all rights and benefits due to him as the legitimate Emir of Kano.
Exparte orders are made in the interest of justice and the preservation of peace in Kano state, according to Presiding Judge Justice S. A. Amobeda, who made the announcement on Tuesday.
The order is as follows; “AN ORDER of interim injunction restraining the Respondents either by themselves, their agents, servants, privies or any other person or authority from inviting, arresting, detaining, threatening, intimidating, harassing the Applicant, raiding, tempering with or visiting the Applicant's in order to arrest or infringe on his right or in any other way infringe or attempt to infringe the Applicant's rights pending the hearing and determination of the Originating Motion.
“AN ORDER restraining the 3,” 4* and 5th Respondents and all other Respondents from denying the applicant to use his official residence and palace at the Emir's Palace, Kofar Kudu as well as enjoyment of all rights and privileges accrued to him by virtue of being Emir of Kano State and to evicting anything, anybody residing within the palace illegally pending the hearing and the determination of the originating summons.”
The lawsuit has been postponed until June 4th in order to have a hearing.
Remember that the State High Court, located at Miller Road, has ordered the Nigerian military, the State Security Service (SSS), and the police to refrain from evicting Muhammadu Sanusi II, the reinstated Emir of Kano.
The four Kano kingmakers, however, Madakin Kano Yusuf Nabahani, Makaman Kano Ibrahim Sarki Abdullahi, Sarkin Bai Mansur Adnan, and Sarkin Dawaki Maituta Bello Tuta, filed the lawsuit with Emir Muhammadu Sanusi II.
Justice Amina Adamu Aliyu, the presiding judge, also gave the security services new instructions not to detain or threaten the emir and his kingmakers.
The judge presided, “That an order of interim injunction is hereby granted restraining the Respondents from attempting to hijack, pick, commandeer, confiscate any of twin spear of authority, the Royal Hat of Dabo, the Ostrich-feathered shoes, the knife and sword of the Emir of Kano as well as symbols of authority pending the hearing and determination of the motion on notice.
“That it is further ordered that the Respondents are restraining from interfering with the functions, and duties of the 1” Applicant as the Emir of Kano pending the hearing and determination of the motion on notice dated 28 May 2024.”
The hearing on the notice motion was postponed until June 13, 2024.
