Court Revokes Arrest Warrant Of Fubara's CoS
THE arrest warrant for Edison Ehie, the chief of staff (CoS), was revoked by a federal high court in Abuja and given to Siminalayi Fubara, the governor of Rivers.
The presiding judge, Emeka Nwite, declared on Thursday that the court lacked authority to issue the order against Ehie and the other five defendants.
Femi Falana and Oluwole Aladedoye, who represented Ehie and five other people, contended at the hearing that the court lacked authority to issue the order as no charges were pending.
The inspector general of police (IGP) filed an ex parte motion in January requesting Ehie's arrest due to his suspected involvement in the fire incident that destroyed a portion of the Rivers state house of assembly complex. Nwite granted the IGP's request.
A court ordered the arrest of Edison Ehie, a former factional speaker of the state assembly, along with five other suspects: Progress Joseph, Jinjiri Bala, Happy Benedict, Adokiye Oyagiri, and Chibuike Peter, popularly known as Rambo.
Sections 37, 113, 114, 84, and 184 of the Administration of Criminal Justice Act (ACJA) 2015, Section 35 of the 1999 Constitution, and Section 32 of the Police Act 2020 served as the foundation for the ex-parte application.
As plans were being made to begin the impeachment process of Fubara, on October 29, 2023, a fire destroyed a portion of the assembly building including the main chamber.
The conflict between Fubara and Nyesom Wike, the former governor of Rivers and minister of the federal capital territory (FCT), sparked the impeachment process.
