Judge directs Kano Hisbah to produce controversial Tik Toker, Murja Kunya
The controversial Kano Tik Toker Murja Ibrahim Kunya filed a bail plea, and the Federal High Court, sitting in Kano and chaired by Justice A M Liman, reserved a decision on the matter on Thursday.
Recall that Kunya was placed under detention by the state Sharia court on an allegation of causing public disturbance, which was filed before it by the Kano Hisbah Board.
She has been held at Abdullah Wase Specialist Hospital for the past 14 days, but during her arraignment a few weeks ago, the Sha'ria court suggested a psychiatric evaluation to assess her mental health.
The Tik Toke influencer asked the Federal High Court to request the enforcement of her fundamental human rights, which she said were being violated, when her attorney became concerned about her ongoing imprisonment without being charged.
She has entered the lawsuit to recover her rights alongside the Kano Hisbah Board, the Kano State Attorney General, the Kano State Commissioner for Justice, and Sharia court.
Additionally, keep in mind that the Hisbah board was already ordered by the court to present the applicant in order to have a hearing on the case.
However, Kunya's attorney, Barr. Y. A. Faragai, brought up Kunya's noticeable absence from the court, which is against the lordship's direction, at the substantive matter's resumed hearing on Thursday.
He maintained that the board's refusal to present his client in defiance of the court's order was an insult to the rule of justice.
Barr. H. H. Sulaiman, a Deputy Director of Civil Litigation, represented all of the respondents in response, telling the court that he had previously asked for the applicant's release from jail and was still awaiting compliance.
The applicant's attorney should proceed with the substantive motion, the court advised, while waiting for Kunya to be brought.
However, Kunya's attorney begged the court to put the case on hold for an hour so that the respondent may present the applicant.
After granting the oral appeal, Justice Liman gave Hisbah an order to bring the contentious Tik Toker before the court by 2:00 PM.
Attorney for the respondents, H.H. Sulaiman, alerted the court to the applicant's presence when the hearing was rescheduled at precisely 2:46 p.m.
He then made a move for a preliminary objection to refute the applicant's bail request.
That being said, Kunya's attorney begged the court to adjourn the case for an hour so that the respondent may present the applicant.
The known Tik Toker was produced before the court by 2 pm, as directed by Justice Liman after the oral appeal was allowed.
H.H. Sulaiman, the respondents' attorney, notified the court of the applicant's presence when the hearing was rescheduled at precisely 2:46 p.m.
The applicant's bail application was then challenged by him through a motion of preliminary objection.
Additionally, Barr. Sulaiman contended that since the applicant is already in front of State High Court Justice Nasiru Saminu on the identical issue, Barr. Faragai's move on notice amounts to an abuse of the legal system.
Following that, Barr. Sulaiman requested that the court reject the application of the fundamental rights.
In his counterargument, Barr. Faragai argued that the court should take jurisdiction over the case and administer justice, arguing that the two cases concurrently addressed the same client but covered distinct topics.
However, Justice Liman, the presiding judge, postponed making a decision until March 28, 2024, after considering the arguments made by both parties.
