16 Nude Videos Found In Suspended UNICAL Dean's Phone — Reports
How sixteen ‘private videos were found on the suspended UNICAL dean's phone’ according to ICPC Forensic and Intelligence Analyst
A Federal High Court, Abuja, on Monday, admitted in evidence two mobile phones seized by the Independent Corrupt Practices and Other Related Offences Commission (ICPC) from Prof. Cyril Ndifon.
Judge James Omotosho admitted the mobile phones—a Tecno Pova phone and an Oppo phone—along with their chargers after Osuobeni Akponimisingha, the ICPC's attorney, tendered them and Joe Agi, SAN, the defense attorney, did not object.
According to reports, Ndifon, the suspended dean of the University of Calabar's (UNICAL) Faculty of Law, was granted bail by Justice Omotosho on Friday in the amount of N250 million, backed by two sureties in an equivalent amount. In addition, Sunny Anyanwu, the attorney charged with Mr. Ndifon, was granted a N50 million bail with two sureties by the judge.
According to NAN, Ndifon and Anyanwu were re-arraigned on January 25 as the first and second defendants on an amended four-count charge that included allegations of sexual harassment and an attempt to stifle the administration of justice.
Anyanwu, who is one of the lawyers in the defence, was joined in the amended charge filed on Jan. 22 by the ICPC on the allegation that he called one of the prosecution witnesses on her mobile telephone during the pendency of the charge against Ndifon to threaten her. At the resumed trial, Akponimisingha told the court that the matter was slated for continuation of hearing and two witnesses were in court.
Mr. Tani Karngong, an exhibit keeper with the ICPC and the third prosecution witness (PW3), stated that his responsibility was to receive and safeguard exhibits that the anti-corruption commission's investigators had taken from suspects. In addition to preserving exhibits, he said he documents them and gives them to a team for forensic examination.
“I am the only one who has access to the exhibit room and I have hand gloves that I wear so that there will be no contamination,” he stated. The PW3 claimed that on October 9, 2023, their investigators delivered the two phones along with pouches containing two documents related to the phones.
He stated that in order to minimize distractions, they made sure the phones were fully charged and in flight mode. According to Fungo, information was taken from the phones using a variety of extraction techniques, including digital cameras.
The PW4 reported that the team generated a timeline chart and a report following the completion of the extraction on the two phones. The witness stated that 128 gigabytes of Universal Serial Bus (USB) held the extracted data from the phones, which included text messages, images, videos, and other files.
According to Bwalgu Funge, the videos that witness TKJ sent were forwarded to a different phone number by Cyril Neddon, the suspended dean of the University of Calabar's Faculty of Law. Additionally, he stated that only three of the 16 nude videos that were taken from Ndifon's phone belonged to TKJ.
TKJ holds a diploma in law, but her name has been suppressed per the court's protective order. In her testimony, she had mentioned that Ndifon had demanded oral sex and her virginity as a condition of being admitted to the full LLB program.
Also, TKJ said that the suspended dean had made her give him oral sex in his car in front of her hostel. Ndifon is currently on trial for sexual harassment and gratification against TKJ and other people.
His attorney, Sunny Anyanwu, has reportedly called TKJ and urged her to decline the ICPC's invitation. Sunny Anyanwu has also joined the case. Fungo, the fourth witness in the reopened trial at the Federal High Court in Abuja on Monday, stated that Ndifon sent TKJ's nede videos to a different number that ends in 617.
Fungo said, “We observed that the videos received were forwarded to another subscriber. What I mean is that the nude videos sent by TKJ to the professor were sent to another number. That number ends with 617. There was also a video sent by TK.J and another phone was used to record the video while being played on the phone.”
“A total of 16 nude videos were extracted from his phone among which TKJ sent three,” Fungo said. The witness told the court that one of the nude videos was sent on September 26, 2023, following a request from the suspended dean.
The WhatsApp conversations, according to Fungo, took place online and displayed requests for and receipts of pornographic videos. Joe Agi (SAN), the defendant's attorney, questioned him on cross-examination about whether the nude videos that were shown in court were done willingly.
In response, Fungo stated that the forensics analysis showed the nude videos were not sent voluntarily. Agi insisted on seeing the naked videos again so the analyst could verify if TKJ was moving her body in the footage, but Fungo insisted there was movement.
To resume his cross-examination of Fungo, Agi requested a postponement. Not only that, but he also requested that the second defendant be taken to the hospital for proper care and that the Nigerian Correctional Service keep him in custody until his N50 million bail was completed. The oral application was approved by trial judge Justice James Omotoso, who postponed the hearing until February 14 in order to continue it.
