The Supreme Court upholds Gombe governor's election



On Friday, the Court of Appeal's decision to uphold Sheriff Oborevwori's election as Delta State governor was upheld by the Supreme Court.


The Peoples Democratic Party's (PDP) Oborevwori was proclaimed the victor of the March 18, 2023, gubernatorial election by the Independent National Electoral Commission.


Other candidates, upset with the poll's results, filed separate petitions with the governorship tribunal. These candidates included Ovie Omo-Agege of the All Progressives Congress (APC), Ken Pela of the Labour Party (LP), and Kenneth Gbagi of the Social Democratic Party (SDP).


On September 29, the Delta State Governorship Election Petition Tribunal, convening in Asaba, affirmed Oborevwori's victory in the governorship election held on March 18.


Also, on November 24, 2023, the Court of Appeal dismissed the APC's appeal, upholding Oborevwori's election.


Unsatisfied with the petition's denial, Omo-Agege and his associates filed an appeal with the Supreme Court, requesting the annulment of the rulings from the two subordinate courts.


Omo-Agege had argued that the election was not carried out in a way that substantially complied with the Electoral Act's rules.


He informed the supreme court that certain polling places had not accurately recorded the results of the governorship race, and that some of the forms containing the recorded results lacked serial numbers.


However, a five-member panel of the supreme court, chaired by Justice Inyang Okoro, dismissed the appeal as incompetent and without merit when rendering a decision on it.


The panel determined unanimously that it required some time to consider the appeal and concluded that the Electoral Act's provisions had been substantially followed.


“The appeal lacks merit and the concurrent findings of the two lower costs are hereby affirmed.


“Appeal is hereby dismissed.


“Parties are to bear their respective costs,” Justice Okoro held.
