KANO GUBERNATORIAL: Appeal Court Dismisses Gov. Abba Yusuf As Governor Of Kano State

The election of Kano State Governor Abba Kabir Yusuf was declared void by the Court of Appeal, which sat in Abuja on Friday



Governor Abba Kabir Yusuf of Kano State has been fired by the Court of Appeal, which is based in Abuja.


The panel maintained the decision of the tribunal that dismissed Yusuf on September 20, 2023, under the direction of Justice Oluyemi Akintan Osadebay.


Recall that the All Progressives Congress (APC) candidate, Nasir Gawuna, was deemed the legitimate winner of the March 18 election by the lower tribunal.


Oluyemi Asadebay led the panel of three judges in the tribunal, and they had decided in favor of the APC candidate.


According to The Nation, following the election on March 18, the Independent National Electoral Commission (INEC) said that the NNPP had received 1,019,602 votes, while the APC had 890,705 votes.


However, the tribunal declared invalid more than 165,663 thumbprints that supported the NNPP. The ballots that were used to cast the votes were not signed or stamped, so the court decided that the votes were taken away. As a result, the tribunal found that the votes were illegitimate.


According to the tribunal, the petitioner was able to substantiate the claim that certain votes were unlawful since the election did not follow the guidelines set forth in the Electoral Act of 2022.


As a result, the tribunal mandated that Yusuf's scores be adjusted to remove the invalid votes.


It insisted that at the time of the election, Governor Yusuf was not a member of the New Nigeria Peoples Party, or NNPP, based on the evidence presented by the parties.


The court claimed that because Yusuf was not legitimately sponsored by the NNPP, he was ineligible to run for governorship under section 177(c) of the 1999 Constitution, as amended.


“A person must be a member of a political party before he can be sponsored for an election.


"A sponsorship that lacks membership is akin to placing something on a blank canvas," the court ruled in Justice M. U. Adumeh's lead judgment.


Governor Yusuf's election was declared void by the Kano state Governorship Election Petition Tribunal, and this decision was affirmed by the appeal court.


Remember that the tribunal removed NNPP governor Yusuf from office in a virtual ruling on September 20 and proclaimed All Progressive Congress's Nasiru Yusuf Gawuna the legitimate victor of the state's March 18 governorship election.
