Naira Marley and Sam Larry sue police and magistrate, demanding N40 million
Entertainer Naira Marley and socialite Sam Larry have launched a lawsuit under the fundamental rights to contest their incarceration following Mohbad's death.
Ilerioluwa Aloba, popularly known as Mohbad was a 27-year-old singer who passed away in Lagos State on Tuesday, September 12, 2023.
On Wednesday, October 4, the magistrate ruled that Naira Marley and Sam Larry would be placed under 21 days of police detention due to Mohbad's death.
Naira Marley, whose actual name is Azeez Fashola, and Samson Eletu are suing the police and Lagos magistrate Adeola Olatunbosun for N20 million apiece, citing their "continuous detention" while under police custody.
The complaint was brought before the Federal High Court in Lagos, and Naira Marley and Sam Larry were added as defendants alongside the police and the Lagos magistrate.
According to the two defendants, their incarceration "at the Hom+cide Section of the Lagos State Police Command, Panti, Yaba, Lagos State since October 4, 2023" has violated their rights, and they are asking the court to proclaim this.
They contended that the magistrate's order of remand, which was only for 21 days, had passed. In their request, they ask for "an order of the court releasing the applicants forthwith."
Recall that Mohbad passed away on September 12, 2023, in a contentious manner, and was buried at Ikorodu the next day.
