BREAKING: Court Dismisses Case Contesting Tinubu's Citizenship And Age And Fines The Plaintiffs N15 Million
A federal high court in Abuja has dismissed a lawsuit that sought to prevent the swearing-in of Bola Tinubu, the All Progressive Congress (APC) candidate for president of Nigeria, with just three days till the inauguration.
The Independent National Electoral Commission (INEC) proclaimed Tinubu the victor of the presidential election held on February 25 with 8,794,726 votes.
Plaintiffs Praise Isaiah, Paul Audu, and Anongu Moses claimed that Tinubu had misrepresented under oath in his form EC9 claiming he was not a citizen of another nation in the lawsuit with the filing number FHC/ABJ/CS/ 657/2023. Additionally, they claimed that the president-elect misrepresented his age under oath.
In a decision on Friday, Justice James Omotosho stated that the lawsuit filed by Praise llemona Isaiah, Pastor Paul Isaac Audu, and Anongu Moses was baseless and an abuse of the legal system. He concluded that the plaintiffs lacked locus standi to bring the lawsuit, and added that the court lacked jurisdiction to consider it since it concerned a presidential election.
Justice Omotosho declared that the legal action was taken in bad faith since it was intended to make the judiciary look foolish, while also accusing the plaintiffs of wasting the court's time by submitting the lawsuit.
It was decided that the lawsuit, which aimed to halt the impending inauguration, had the potential to undermine the nation's democracy.
As a result, Justice Omotosho dismissed the case and gave each respondent a cost award of N10m in Tinubu's favor, N5m in the APC's favor, and another Nm to be paid personally by the plaintiffs' attorneys.
