PRESIDENCY: BOLA TINUBU WINS IN COURT
Bola Tinubu's bid to be declared ineligible to run in the 2023 elections was rejected by a Federal High Court in Abuja.
The presidential candidate for the All Progressives Congress (APC) was sued by the Action Peoples Party (APP).
The Independent National Electoral Commission (INEC) was added as the first defendant in the FHC/UM/CS/124/2022.
The ruling APC is the third defendant, followed by the former governor of Lagos.
According to the plaintiff's claims, Tinubu reportedly provided the first defendant with incorrect information on his form EC9.
They claimed he omitted information about his elementary and secondary schooling from the form CF001 he completed in 1999 before the governor's race.
Sections 29 of the Electoral Act of 2022 and 131 of the Nigerian Constitution of 1999 were referenced by the APP.
Babatunde Ogala, an attorney for the APC, submitted a notice of preliminary objection, claiming that the APP lacked locus standi and that the lawsuit was time-barred.
Speaking on behalf of the APC, Bayo Onanuga claimed that the plaintiff was not present when the case was heard by Justice Emeka Nwite.
"Justice Nwite subsequently struck out the case for lack of diligent prosecution," Onanuga added.
